Nine MLS Boards, Nine Different Rules for Disclosing Virtually Staged Photos

eTradeWire News/10851847
JACKSONVILLE, Fla. - eTradeWire -- Nine multiple listing service boards have now answered RELTO in writing with their rules for disclosing virtually staged listing photos, RELTO announced today. RELTO contacted 15 boards to confirm the summaries in its free MLS photo rules database. Seven of the nine replies arrived on a single day, Monday, November 2, 2026. Together, they show there is no single national way to disclose a staged photo.

The answers often point in opposite directions. Canopy MLS confirmed that a disclosure label must sit directly on the image, clear and readily visible, and that captions alone do not count. West Penn Multi-List confirmed the opposite. Its disclosure is a checkbox in the MLS, and no text or watermarks are permitted on images at all. BeachesMLS confirmed that an on-image watermark is itself a violation, and that disclosure belongs in the first 180 characters of public remarks. San Diego MLS confirmed its label sits on the listing record only, never on the photo.

Other boards split the difference in different ways. CRMLS confirmed that a photo caption is sufficient, and that placing the original directly before or after the altered image satisfies Rule 11.5.2, which is pursuant to California AB 723. That law took effect January 1, 2026, and willful violations carry misdemeanor exposure. ARMLS confirmed that disclosure is its system-provided watermark, and that a vendor may not add its own watermark without ARMLS approval. SABOR confirmed disclosure is a pick list selection under the photo description. MAAR, the Memphis board, confirmed disclosure in REALTOR Remarks only, with no words on any property photograph.

NTREIS, the North Texas MLS, adopted a dedicated rule for AI and virtually altered images effective November 1, 2026, with an education period through January 31, 2027 and enforcement, including fines, starting February 1, 2027. One board's answer can violate another's.

"Agents are not careless. They are working from rulebooks that contradict each other," a RELTO spokesperson said. "That is why we asked the boards themselves, in writing, and credit each answer to the board that gave it." RELTO is updating its board pages as confirmations land, and its platform supports MLS disclosure rules board by board. RELTOLock™ verifies RELTO's own staged outputs only, measuring windows and doors against the original photo plus the room framing, and the mark is withheld if anything moved.
