Complainant Files to Dismiss Last Trump Criminal Case

Impossibility of Proceeding, and the Public Interest, Cited as Reasons
WASHINGTON - eTradeWire -- The activist law professor who filed the formal complaint which led to the still pending criminal indictment of Donald Trump in Georgia has filed a request with the prosecutor that, in view of Trump's election and the virtually certain dismissal of the other criminal cases still pending against him, DA Fani Willis dismiss or otherwise dispose of the Fulton County criminal case against the president elect.
His formal request comes as reports indicate that special counsel Jack Smith will be dismissing the two federal criminal cases against Trump. and that New York Judge Juan Merchan is seriously considering dismissing the Trump criminal case under his purview because of the president-elect's decisive victory and the Supreme Court's immunity ruling.
Both arguments are as applicable in Georgia as well as elsewhere, argues public interest law professor John Banzhaf who filed the complaint accusing Trump of numerous violations of Georgia's criminal law which led to his criminal RICO indictment in Fulton County.

He argues that to DA Willis that, even if you take no action, it seems increasingly unlikely that Trump will go to trial. As he recently suggested: "the RICO charges against Trump are unlikely to go to trial 'for at least four years,' due to his presidency win and his pending appeal to remove Fulton County District Attorney Fani Willis from prosecuting the case over alleged misconduct. Even if his appeal fails, it is very unlikely that courts—including, if necessary, the U.S. Supreme Court—would permit a local state criminal trial to proceed against a sitting president, or even against a president elect," especially in your case in which the immunity ruling might provide a defense to most if not virtually all of your case against Trump.

Banzhaf concluded his request by saying "in summary, given the extraordinary circumstances regarding this entire matter - especially with Trump's overwhelming victory, and also with the upcoming court of appeals argument - it would appear that both the national public interest and the interests of the majority of Georgians, as well as your own interests, would be best served by dropping or otherwise disposing of the criminal proceeding against Trump.
He suggested that "clearly no reasonable person could possibly blame you for reluctantly taking such action under these most unusual circumstances which virtually compel a dismissal, especially when requested by the complainant himself."
